5. Tracking Technologies

We use cookies on our website. These are small files that your browser automatically creates and stores on your device (laptop, tablet, smartphone, etc.) when you visit our site. Information related to the specific device used is stored in the cookie. However, this does not mean that we immediately gain knowledge of your identity. The use of cookies serves to make the use of our offer more pleasant for you. For example, we use session cookies to recognize that you have already visited individual pages of our website.

In addition, we use temporary cookies to optimize user-friendliness, which are stored on your device for a specific period. If you visit our site again to use our services, it will automatically recognize that you have already been with us and what inputs and settings you have made so that you do not have to enter them again. We also use cookies to statistically record the use of our website and evaluate it for the purpose of optimizing our offer for you. These cookies allow us to automatically recognize that you have already been with us when you visit our site again.

The data processed by cookies is necessary for the purposes mentioned. Most browsers accept cookies automatically. However, you can configure your browser so that no cookies are stored on your computer or a notice always appears before a new cookie is created. However, completely disabling cookies may mean that you cannot use all the functions of our website.

6. Web and Newsletter Analysis

To gain insights into the use of our website, improve our internet offer, and address you with advertising on third-party websites or social media, we use the following web analysis tools and re-targeting technologies: Google Analytics, Facebook, Mailchimp.

These tools are provided by third-party providers. The information collected for this purpose about the use of a website is usually transmitted to the server of the third-party provider using cookies or similar technologies. Depending on the third-party provider, these servers may be located abroad.

The data is usually transmitted with shortened IP addresses, preventing the identification of individual devices. The transmission of this information by third-party providers only takes place due to legal regulations or within the framework of order data processing.

6.1. Google Analytics

We use Google Analytics, the web analysis service of Google LLC, Mountain View, California, USA, responsible for Europe is Google Limited Ireland ("Google"). To disable Google Analytics, Google provides a browser plug-in at https://tools.google.com/dlpage/gaoptout?hl=de. Google Analytics uses cookies, which are small text files that allow specific, user-related information to be stored on the user's device. These enable Google to analyze the use of our website offer. The information collected by the cookie about the use of our pages (including your IP address) is usually transmitted to a Google server in the USA and stored there. We point out that Google Analytics on this website has been extended by the code "gat._anonymizeIp();" to ensure anonymized collection of IP addresses (so-called IP masking). If anonymization is active, Google shortens IP addresses within member states of the European Union or in other contracting states of the Agreement on the European Economic Area, so that no conclusions can be drawn about your identity. Only in exceptional cases is the full IP address transmitted to a Google server in the USA and shortened there. Google may associate your IP address with other data from Google. For data transfers to the USA, Google has committed to signing and complying with the EU standard contractual clauses.

6.2. Google Maps

We use Google Maps (API) from Google Inc. (1600 Amphitheatre Parkway, Mountain View, CA 94043, USA; responsible for Europe is Google Limited Ireland, "Google") on our website. Google Maps is a web service for displaying interactive (land) maps to visually represent geographical information. By using this service, our location is displayed to you and any route planning is facilitated. When you call up the subpages in which the Google Maps map is integrated, information about your use of our website (such as your IP address) is transmitted to Google servers in the USA and stored there. This happens regardless of whether Google provides a user account through which you are logged in or whether no user account exists. If you are logged in to Google, your data is directly assigned to your account. If you do not want the assignment to your profile at Google, you must log out before activating the button. Google stores your data (even for non-logged-in users) as usage profiles and evaluates them. For data transfers to the USA, Google has committed to signing and complying with the EU standard contractual clauses.

6.3. Social Media Plugins

We use so-called social media plugins ("plugins") from third-party providers on our website. The plugins are recognizable by the logo of the respective social network. Through the plugins, we offer you the opportunity to interact with social networks and other users. We use the following plugins on our website: Facebook, Instagram, Twitter, LinkedIn, YouTube. When you visit our website, your browser establishes a direct connection to the servers of the third-party provider. The content of the plugin (e.g., YouTube videos) is transmitted directly from the respective third-party provider to your browser and integrated into the page.

The data transfer for displaying content (e.g., publications on Twitter) occurs regardless of whether you have an account with the third-party provider and are logged in there. If you are logged in to the third-party provider, the data collected by us will also be directly assigned to your existing account with the third-party provider. If you activate the plugins, the information will also be published in the social network and displayed to your contacts there. For the purpose and scope of data collection and further processing and use of the data by the third-party providers, as well as your rights and settings options to protect your privacy, please refer to the privacy notices of the third-party providers. The third-party provider stores the data collected about you as usage profiles and uses them for advertising, market research, and/or needs-based design of its website. Such evaluation is carried out particularly for non-logged-in users to display needs-based advertising and to inform other users of the social network about your activities on our website. If you want to prevent the third-party providers from assigning the data collected via our website to your personal profile in the respective social network, you must log out of the corresponding social network before visiting our website. You can also completely prevent the loading of the plugins with specialized add-ons for your browser, such as "Ghostery" (https://www.ghostery.com/) or "NoScript" (http://noscript.net/).

6.4. Newsletter Tracking

For sending our digital newsletters, we use the software Mailchimp. This software allows newsletters to be sent and analyzed. To perform this analysis, we collect device and access data. To collect this data, the newsletter contains a pixel. The newsletter and the websites accessible from this newsletter are also tracked with cookies. A pixel is an image file that is stored on the recipient's device.

With the help of these technologies, we receive information about whether the newsletter has arrived, been opened, and which content has been clicked. We use this information to improve our newsletter and our offers. The setting of a pixel can be prevented by disabling HTML in the mail program (varies depending on the mail program).

7. Data Transfer and Data Transmission

We only transfer your data to third parties if it is necessary to provide our service, if these third parties provide a service for us, if we are legally or officially obliged to do so, or if we have an overriding interest in transferring the personal data. We will also transfer personal data to third parties if you have given your consent or requested us to do so.

Not all personal data is transmitted encrypted by default. Unless explicitly agreed otherwise with the customer, all data is transmitted unencrypted.

The following categories of recipients may receive personal data from us:

We conclude contracts with service providers who process personal data on our behalf, obliging them to ensure data protection. Our service providers are mostly located in Switzerland or the EU/EEA. Certain personal data may also be transmitted to the USA (e.g., Google Analytics data) or, in exceptional cases, to other countries worldwide. If data transmission to other countries that do not have an adequate level of data protection is necessary, it is carried out based on the EU standard contractual clauses (e.g., in the case of Google) or other suitable instruments.

8. Duration of Storage of Personal Data

We process and store your personal data as long as it is necessary to fulfill our contractual and legal obligations or other purposes pursued with the processing, i.e., for example, for the duration of the entire business relationship (from initiation, processing to termination of a contract) and beyond according to legal retention and documentation obligations. It is possible that personal data is retained for the period during which claims can be made against our company (i.e., particularly during the statutory limitation period) and as long as we are otherwise legally obliged or legitimate business interests require it (e.g., for evidence and documentation purposes). Once your personal data is no longer required for the above purposes, it will generally be deleted or anonymized as far as possible. For operational data (e.g., system logs), shorter retention periods of twelve months or less generally apply.

9. Data Security

We take appropriate technical and organizational security measures to protect your personal data:

This can be achieved through the issuance of instructions, training, IT and network security solutions, access controls and restrictions, encryption of data carriers and transmissions, pseudonymization, and controls.

The data protection officer of Kurkuma Communication GmbH is involved from the beginning in new projects and regularly reviews data security according to the principles, goals, and TOMs in Art. 1 to 3 DSV.

10. Obligation to Provide Personal Data

Within the scope of our business relationship, you must provide the personal data necessary for establishing and conducting a business relationship and fulfilling the associated contractual obligations (you generally do not have a legal obligation to provide us with data). Without this data, we will not be able to enter into or process a contract with you (or the entity or person you represent). The website also cannot be used if certain information required to ensure data traffic (such as IP address) is not disclosed.

11. Your Rights

In connection with our processing of personal data, you have the following rights:

To exercise these rights, please contact the address provided in section 1. Please note, however, that we reserve the right to assert the legally provided restrictions, for example, if we are obliged to retain or process certain data, have an overriding interest (as far as we may rely on it), or need it to assert claims. If costs arise for you, we will inform you in advance.

12. Amendment of the Privacy Policy

We expressly reserve the right to change this privacy policy at any time.

Last change: September 2023
